Seed Swap Rules

The following rules govern the use of the Almanac.com Seed Swap. Please read these rules carefully. Your use of Almanac.com Seed Swap will constitute your agreement to comply with these rules. If you cannot agree with these rules, please do not use the service. These rules may be modified by The Old Farmer's Almanac from time to time; changes will be announced.

Swaps are not endorsed by The Old Farmer's Almanac: "Let the swappers beware!" should be your motto if you choose to participate.

Seed Swaps must consist of seeds only — no plants, other products, or services. Swapping for pay is not permitted. Also, you may not post comments or opinions about the swaps you see posted. Only legal transactions are acceptable.

Prohibited Materials and Activities

You agree not to use any obscene or offensive language in posting your swap. If your swap constitutes junk mail or unauthorized advertising, invades anyone's privacy, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law or regulation then it will be removed. You agree to use the Almanac.com Seed Swap only for lawful purposes.

Material on Almanac.com Seed Swap is for your personal use only. The service contains copyrighted and other proprietary information. You may not in any way make commercial or other unauthorized use, by publication, retransmission, distribution, or otherwise, of material obtained through Almanac.com Seed Swap, except as permitted by the Copyright Act or other law.

You agree not to disrupt or interfere with Almanac.com Seed Swap, nor to alter or tamper with any information or materials on or associated with the service.

Use of Material Posted by You

Postings to Almanac.com Seed Swap are not private. You grant The Old Farmer's Almanac the unrestricted right to use, reproduce, modify, translate, and distribute any material you post to the service for any purpose, including commercial uses, and to authorize others to do so.

Indemnification

You agree to indemnify The Old Farmer's Almanac and its employees, agents, and representatives, and to hold them harmless, from any and all claims and liabilities (including attorneys' fees) that may arise from your submissions, from your unauthorized use of material obtained through the service, or for your breach of these rules. You agree further that Yankee Publishing is not responsible, and shall have no liability to you, with respect to any material posted by others.

Editing and Deletion

The Old Farmer's Almanac reserves the right, but undertakes no duty, to review, edit, move, or delete any material provided for display or placed on the service or its bulletin boards, at its sole discretion.

DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY: THE SERVICE PROVIDED "AS IS," AND THE SERVICE PROVIDER HEREBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESSED AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

YOU USE THE SERVICE AND THE INFORMATION AND MATERIAL ON THE SERVICE AT YOUR OWN RISK. THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY DAMAGES ALLEGEDLY SUSTAINED ARISING OUT OF THE USE OF THE SERVICE, INCLUDING FOR COMPUTER VIRUSES ALLEGED TO HAVE BEEN OBTAINED FROM THE SERVICE AND INCLUDING ANY CONSEQUENTIAL, SPECIAL OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
